Terms of Use

1. Accepting these terms

These Terms of Use (the “Terms”) form a binding agreement between you and STORIES AR LLC, a Wyoming limited liability company and the developer of Lifoto (“we”, “us”), covering the Lifoto iPhone app and the website at lifoto.app (the “Service”). By downloading, installing or using Lifoto you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy is part of these Terms. You must be at least 13 years old, or the minimum age of digital consent where you live, to use Lifoto.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Lifoto on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and including devices in your Family Sharing group where we have enabled it. The Service is licensed, not sold. We retain all rights in the app, its models, design and brand.

You may not: copy, sell, rent, sublicense or redistribute the app; reverse engineer, decompile or disassemble it except where that restriction is prohibited by law; remove watermarks or proprietary notices; use automated means to access our providers through the app; or circumvent generation limits, the paywall or any technical restriction.

3. Free tier

Lifoto includes 8 free video generations per install, with no account and no payment details. Free videos are short drafts and carry a watermark. The allowance is per installation and does not refresh, transfer between devices, or carry a cash value. We may change the size of the free tier for new installs.

4. Lifoto Pro — subscriptions and free trial

Lifoto Pro is an auto-renewing subscription sold in two durations from a single subscription group:

Prices are shown in the App Store for your region and may differ from the US prices above because of local taxes and currency. Pro includes unlimited standard generations, HD renders with custom motion prompts (subject to §5), no watermark, and saving and exporting videos.

• 3-day free trial. New subscribers get a 3-day free trial. The trial is granted once per subscription group — taking it on one duration uses it for both. If you cancel before the trial ends, you are not charged.
• Billing. Payment is charged to your Apple ID account at confirmation of purchase, or at the end of the free trial.
• Auto-renewal. The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing and cancelling. Manage or cancel at any time in Settings › your Apple Account › Subscriptions on your iPhone. Deleting the app does not cancel a subscription.
• Unused free tier. Any unused portion of a free allowance is forfeited when you buy a subscription.
• Refunds. Purchases are handled by Apple, so refunds are governed by Apple's policy and requested through Apple, not us. We cannot issue refunds for App Store purchases.
• Price changes. We may change subscription prices. Apple will notify you and ask for consent where required before a changed price takes effect; you can cancel instead.

5. HD renders and fair use

Pro describes HD renders as unlimited for normal personal use. Because each HD render costs us real compute, we apply a reasonable fair-use limit to prevent automated or commercial-scale bulk generation. If you reach it, the app tells you and HD renders resume after a short period; standard generations are unaffected. We may adjust the threshold, and we will not use it to deny genuinely normal personal use.

6. Your content

“Your Content” means the photos you point the camera at and choose to animate, the prompts you write, and any video you attach from your photo library.

• You keep ownership. We claim no ownership of Your Content.
• You give us only what we need. You grant us and our processing providers a limited licence to store, transmit and process Your Content strictly to operate the Service and produce the video you requested. Nothing more. We do not use Your Content to train models and we do not license it to anyone.
• You promise you have the rights. You confirm you own Your Content or otherwise have permission to use it, including permission from any identifiable person appearing in it, and that using it through Lifoto breaks no law and no one else's rights.

7. AI-generated output

Lifoto uses generative AI. That has consequences you should understand before relying on the result:

• Output is probabilistic. The same photo can produce different motion on different runs, and results range from convincing to strange. This is a property of the technology, not a defect in the app.
• Output is a creative interpretation, not a record. It invents motion that never happened. Do not present a Lifoto video as documentary footage, evidence, or a real recording of anyone.
• Similar inputs may produce similar outputs for other users; we cannot promise your result is unique.
• As between you and us, you own the videos you generate from Your Content, subject to these Terms and our providers' terms. Whether AI output attracts copyright at all varies by country and is outside our control.
• You are responsible for how you use and share what you generate.

8. Acceptable use

You must not use Lifoto to create, store or share content that:

• sexualises minors in any way, or depicts child sexual abuse;
• is intimate or sexual imagery of a real person made or shared without their consent;
• impersonates a real person, or fabricates their words or actions, in order to deceive, defraud, harass or defame;
• infringes copyright, trademark, privacy or publicity rights;
• promotes violence, terrorism, self-harm or unlawful discrimination, or harasses or bullies anyone;
• violates any applicable law, or the terms of Apple or of our AI providers.

You must also not attempt to disrupt the Service, probe or attack our providers through the app, extract our API keys, or use the app to build a competing service.

We may suspend or terminate access to the Service, and refuse to process content, if we reasonably believe this section has been breached.

9. Availability and changes

Lifoto requires an AR-capable iPhone running iOS 16 or later, plus an internet connection for video generation. We may change, suspend or discontinue features at any time, including because a third-party AI provider changes its own service, pricing or availability. If we discontinue a paid feature materially and permanently, you may cancel your subscription; renewals already charged are handled under Apple's refund policy.

We may update these Terms. Material changes will be reflected in the “last updated” date and, where significant, noted in the app's release notes. Continued use after a change means you accept the revised Terms.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about the accuracy, quality, aesthetics or usefulness of generated videos. We do not warrant that detection will recognise every print, that generation will always succeed, or that the Service will be uninterrupted or error-free.

Nothing in these Terms excludes or limits rights you have as a consumer that cannot be excluded or limited under the law of your country of residence.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service — including loss of markers or videos stored only on your device, which you should back up if they matter to you.

Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) US$50.

You agree to indemnify us against claims, damages and reasonable costs arising from Your Content, from your use of the Service, or from your breach of these Terms or of any law.

12. Apple-specific terms

These provisions apply because Lifoto is distributed through the App Store:

• These Terms are between you and us only, not with Apple. Apple is not responsible for Lifoto or its content.
• Apple has no obligation to provide maintenance or support for Lifoto. Support requests go to evdodima@gmail.com.
• If Lifoto fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Lifoto.
• We, not Apple, are responsible for addressing any claim by you or a third party relating to Lifoto, including product liability claims, failure to conform to legal requirements, and consumer protection claims.
• We, not Apple, are responsible for investigating and defending any third-party claim that Lifoto infringes intellectual property rights.
• You confirm you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

13. Termination

You may end this agreement at any time by deleting Lifoto — and, separately, by cancelling any subscription through Apple. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (content licences already granted, disclaimers, liability limits, indemnity, governing law) survive it.

14. Governing law, disputes and contact

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction over any dispute — except as stated in the next paragraph.

If you are a consumer, nothing in this clause deprives you of the protection of the mandatory consumer-protection laws of your country of residence, or of your right to bring proceedings in the courts of the place where you live, where those laws grant it.
